This Privacy Policy describes how Breathing Records ("we," "us," or "our") collects, uses, and protects information in connection with Breathing Records Artist Hub (the "Hub"), our content management tool for signed artists and affiliated creators. This policy applies specifically to the Hub and its TikTok integration. It is separate from any policies governing breathingrecords.com generally or our online shop.

1. Who we are

Breathing Records is a DBA registered in California, located at 3960 West Point Loma Blvd Suite H 5044, San Diego, CA 92110. Contact: info@breathingrecords.com.

2. Who this policy applies to

The Hub is used by signed artists on Breathing Records, creators in the event network, affiliated JON ECHOES creators, and their authorized representatives. If you are using the Hub, this policy applies to you.

3. Information we collect

From TikTok, when a brand connects an account:

A user with membership to a brand in the Hub initiates the connection on that brand's behalf. When the connection completes, we receive and store the following from TikTok, associated with the brand (not the individual user who initiated the connection):

  • TikTok display name, username, profile image, and basic account information (via the user.info.basic scope)
  • Metadata about videos uploaded, scheduled, or published through the Hub (via the video.publish and video.upload scopes)
  • Authorization tokens that allow the Hub to act on behalf of the connected TikTok account, only for the actions authorized

This information is accessible to all users who are members of that brand in the Hub. The user who initiated the connection is recorded for audit purposes.

From you directly:

  • Your name and email address when your Hub account is set up
  • Brands you are added as a member to
  • Content you upload to the Hub for scheduling or publishing
  • Scheduling preferences and post drafts

4. How we use information

We use the information collected solely to:

  • Authenticate you and your TikTok account
  • Publish, schedule, or draft content to TikTok at your direction
  • Display your scheduled and published post history within the Hub
  • Communicate with you about your account or the service

We do not use information from TikTok for advertising, profiling, machine learning training, resale, or any purpose unrelated to the publishing actions you authorize.

5. How we share information

We do not sell or rent your information. We share it only with:

  • TikTok, as required to fulfill the publishing actions you initiate, in accordance with TikTok's Developer Terms of Service
  • Service providers we use to operate the Hub (hosting, error monitoring, email), under contractual confidentiality obligations
  • Legal authorities, only when required by valid legal process

6. Data retention and deletion

We retain TikTok-derived data only as long as your account is connected to the Hub. You may disconnect your TikTok account at any time, which revokes our access tokens and stops further data collection. You may also request deletion of all data associated with your Hub account by emailing info@breathingrecords.com; we will complete deletion within 30 days, except where retention is required by law.

7. Your rights

Depending on where you live, you may have rights to access, correct, or delete personal information we hold about you, or to object to certain uses. Contact info@breathingrecords.com to exercise these rights. California residents have specific rights under the CCPA/CPRA, including the right to know, delete, correct, and opt out of sale (we do not sell personal information).

8. Security

We use industry-standard measures to protect data, including encrypted storage of TikTok access tokens and encrypted transmission. No system is perfectly secure, and we cannot guarantee absolute security.

9. Children

The Hub is not intended for users under 18. We do not knowingly collect information from minors.

10. Changes to this policy

We may update this policy. Material changes will be communicated to active Hub users by email, and the "Last updated" date above will be revised.
